Terms and Conditions

These Terms and Conditions govern all contracts, sales, and services provided by The Civic Union Wear e.U., Gassergasse 39/8, 1050 Wien, Austria, registered as a sole proprietorship under Austrian law, represented by Alejandro Jorquera Martinez (“Seller”). By placing an order, you (“Customer”) agree to the following terms:

1. Conclusion of Contract

A purchase contract is formed once your order is confirmed by us via email or implicitly by dispatching the goods. Product presentation in our shop is non-binding.

2. Prices and Payment

All prices are stated in EUR and include VAT where applicable.
Accepted payment methods: bank transfer, credit/debit card, and secure online gateways (e.g. Klarna, PayPal)
Orders are processed after full payment is received.

3. Delivery and Shipping

We ship within the EU. Delivery time is typically 3–5 business days from payment confirmation.
Shipping costs are shown at checkout.
Risk transfers to the customer upon handover to the carrier (except for consumers, per § 7b KSchG – risk transfers only upon delivery).

4. Retention of Title

Goods remain the property of The Civic Union Wear e.U. until full payment is received. Customers must not resell or pledge unpaid goods.

5. Right of Withdrawal

Private consumers have a 14-day right of withdrawal (see below).

6. Warranty

Statutory warranty rights apply for 2 years from delivery (§ 922 ABGB).
Defects must be reported within a reasonable time (ideally 14 days after discovery).
Excludes damage from misuse or normal wear and tear.

7. Governing Law and Jurisdiction

Austrian law applies, excluding the UN Sales Convention.
For consumers, the court of their residence applies; otherwise, Vienna, Austria is the place of jurisdiction.

Cancellation Policy

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day you or a third party named by you (other than the carrier) took possession of the goods.

Consequences of Withdrawal

We will refund all payments received from you, including delivery costs (except any extra costs from choosing a non-standard delivery method), within 14 days from receiving your withdrawal notice.

Refunds will use the same payment method unless otherwise agreed.

We may withhold the refund until we receive the goods back or proof of their return, whichever is earlier.

You must return the goods no later than 14 days from informing us of your withdrawal.
You bear the direct cost of returning the goods.

You are only liable for any loss in value if caused by handling beyond what is necessary to check the nature, characteristics and functioning of the goods.

All legal information on this page is provided in accordance with Austrian and EU consumer protection law as of 15.06.2025. Should any changes to the law require updates, we will revise these policies accordingly.
